1. Reservation/transfer posting:
You will receive a written confirmation, which will be binding after you signed
it and returned the reservation form back to Mallorca Holiday Villas. With
your signature, you (and your travelling party) are obliged to all contractual
obligations in accordance with the hire conditions. The contract is only
valid for the period of time, the named holiday cottage and the number of
persons on the application form. You are not permitted to occupy the accommodations
with more than the number of persons named on the above mentioned form. If
a modification is necessary, like changing the date of arrival, number of
persons and/or change of accommodations, we will have to bill you EURO 40,00
modification costs. If it is not possible to change the contract, you have
to make a new reservation. The content in the confirmation are related to
contractual obligations. Special agreements are only valid in writing and
with a confirmation in writing. 2. Payment:
In advance you will have to pay the down-payment(see bookings form) within
10 days after confirmation. The rest of the total sum is due on arrival in
cash (Euros), without prior notice from our side. Non-payments is considered
as a resignation and entitle Mallorca Holiday Villas to let the accommodation
otherwise. 3. Cancellation:
The height of the cancellation fee depends on the period before the start of
the holiday. This fee will be 10% of the total amount if the remaining period
of days is 90 day are more. If your cancellation is in-between 60 and 90 days,
the fee will be 25%; in-between 30 and 60 days, the fee will be 50%; 30 days
are less means a fee of 100% . Beware: You are also obliged to pay the fee
when you are not responsible for the cancellation. Any cancellation needs to
be done in writing. 4. Performances:
The performances, offered by Mallorca Holiday Villas, are only as a mediator
between the landlord (owner, manager) and the tenants. All claims for damages
are malfunctions, the tenant has to report to the landlord (owner, manager)
within 24 hours. The contract is between the landlord (owner, manager) and
the tenant (who signed the reservation form). The contract is only valid for
the amount of persons, the given period and the named domestic animals. We
recommend that you will conclude a travel insurance (including travel cancellation,
loss of luggage and insurance against accidents). 5. Claim:
The description of the objects has been created with best knowledge and according
to the specification of the owner. The consequences of higher force on the
holiday cottage by, for example strike, war, earthquake, no current supply
and water failures are not guaranteed. Likewise, we are not responsible for
a constant readiness of installations such as central heating, pool, noise
desturbance by building activities on adjoining properties, etc. If the use
of the rented object is not possible and no other object is obtainable due
to higher forces, then the restitution is limited to max. of the height of
the agreed payment of balance. An adhesion for temporary disturbances in the
water / current supply or disturbances by nature-conditioned or local occurrences
is excluded. 6. Obligation to co-operate:
With the possibly of unexpected problems the tenant is obligated to do in the
context of the legal regulations of everything in order to contribute to a
recovery of the disturbance and to keep the developed damage as small as possibly.
The tenant has to check the inventory-list and report missing inventory to
the owner within 24 hours on arrival. Every other malfunction has to be reported
to the owner immediately. The tenant has to be careful with the cottage and
the inventory. The damage caused during your stay is to be reported to the
owner.
The rented accommodation is clean, to leave i.e. broom and cabinet clean. 7. Arrival/departure:
The renting object can be supplied on the journey day starting from approx.
16:00 o'clock; on the departure day the tenant leaves the house at the latest
10:00 o'clock Should the tenant want to leave the cottage after 10:00 o'clock,
the tenant must have an agreement in writing from the landlord or its representatives. 8. Domestic animals:
Bringing along domestic animals requires the written permission of the owner.
The tenant is responsible for all damage caused by the animal. In each case
you need to deposit a bail of EURO 150, - with will be returned after your
stay and no damages to the property. 9. Area of jurisdiction
: All claims for damages of the tenant are to the respective landlords, owner
or managers of the holiday-cottage. Place of delivery and area of jurisdiction
is the respectively place of the real estate or the residence of the owner,
landlords or managers. 10. Other:
All alterations of the contract require a written confirmation from Mallorca
Holiday Villas to become effective.
