TERMS AND CONDITIONS
Mallorca Holiday Villas are trademarks of Morro Norte, S.L., Mallorca Holiday Villas, organized the accommodation for the owners of the properties featured on our website. Your contract is with the Property Owner.
2. FORMATION OF CONTRACT
2.1 - Before making a reservation, you must contact us for confirmation that your chosen property is available for the dates requested.
2.2 - To make your reservation you must email us the following information: Completed and signed the booking form provided by us a reservation request. A copy of your passport or valid driver's license. A proof of payment of non-refundable deposit if you decide to pay by bank transfer.
2.3 - A binding contract between the person who signed the booking form and the Property Owner will be made after confirmation of receipt of all information from the previous point.
2.4 - You are responsible for paying the price of the holiday and compliance of members of your party with these conditions.
2.5 - Reservations can not be accepted from persons under 18 years of age at the time of booking. We reserve the right to refuse a booking without giving any reason.
2.6 - The reception of the booking form without proof of payment and / or copy of your passport / valid driving license does not constitute acceptance of any booking.
3.1 - The balance must be paid no later than one week before arrival unless otherwise agreed by email. Failure to pay the balance on time will constitute cancellation fees and cancellation shall be payable in accordance with clause 6.
3.2 - Receipt and banking of any deposit by itself, does not constitute acceptance of any booking.
Prices shown are in Euros, and the rental period is weekly, unless otherwise indicated. The property will be clean at the beginning of the rental period and is asked to kindly leave at end of period reasonable conditions. The company has the right to charge for any additional cleaning necessary at the time of departure should not be left the property in a proper condition ie excessive amount of trash, stained sheets, curtains, etc. within reason. The housekeeping does not include dishes or garbage disposal. Properties are let fully furnished and equipped. Bed linen is included in all our properties, but it is advisable to take beach towels and cot linen. Sheets and towels are usually changed once a week when the stay is longer than 2 weeks. Some properties may include additional cleaning in price or that may be available upon request. Additional cleaning service special order will be paid upon arrival. Please contact our agents before arrival for more information. If your property has a pool, this will be reviewed periodically. Note that in adverse weather conditions (intense heat, rain, mud, etc.) chemicals in the water could unbalance. Please contact our agents in order to solve the problem as soon as possible. 5. breakage deposit
All properties require payment of a bond to cover the cost of any damage or breakages to the property or its contents. The deposit will be paid with your rental balance. This amount will be returned to you on departure day if possible or, where applicable, by bank transfer, less any damages, losses, unpaid bills, etc.
6. ALTERATION OR CANCELLATION BY US
Because we begin planning the arrangements we offer many months in advance, we reserve the right to make changes and correct errors in holiday details before and after bookings have been confirmed. We also reserve the right to cancel confirmed reservations. Occasionally, you may have to make a significant change. Examples of significant changes include the following when made before departure; a change of accommodation area for all or a significant portion of your vacation, a change of accommodation to a lower classification for all or a significant part of your holiday, the closing of the only or all pool announced ( s) in its housing for an extended period. No compensation will be offered and are not responsible for these changes initiated by the circumstances surrounding the villa. If we have to make a significant change or cancel, we will inform you as soon as possible and if there is time to do so before departure, we offer the following options:
(A) For significant changes, accepting the changed arrangements or
(B) The purchase of alternative arrangements of us, similar to those initially reserved level, if available (if the chosen alternative is less expensive than the original, we will refund the difference but if it is more expensive, we ask that pay the difference) and you can not cancel your holiday without cancellation charges apply.
(C) If we can not offer alternative accommodation will be a full and immediate refund.
We will not pay compensation when we make a significant change or canceled as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which could not have avoided even with all due care. We will not pay compensation and the above options (a), (b), (c), will not be available if we make a minor change or cancel as a result of their lack of full payment on time. We regret that we can not afford the expenses, costs or losses incurred by you as a result of any change or cancellation. In rare circumstances, we may be forced by force majeure to change or terminate their accommodation. If this situation occurs, we regret we can not make any refunds (unless we obtain any of our suppliers), pay compensation or face costs or expenses incurred as a result. We reserve the right to treat a change of dates of the property and / or vacation as a cancellation of a holiday and the booking of another.
7. CANCELLATION BY YOU
7.1 Any cancellation by you must be notified to us in writing by e-mail. The effective date of cancellation is the date on which written notice is received by us.
7.2 The following fees are paid according to the time that the notification of cancellation is received:
60 days or more before arrival: deposit forfeited.
Within 59 days of the arrival date: 100% of the total cost of the reservation.
8. INFORMATION VILLA
8.1 Please note that some of the images that appear on our website may have been taken with wide angle lenses in order to provide a wider perspective of the property. Photographs taken at our properties can not be used or sold for profit without permission from Mallorca Holiday Villas.
8.2 While we make every effort to ensure that descriptions supplied are reproduced accurately, we can not accept responsibility for errors contained therein or the results thereof. minor differences between the photograph / illustration / text used and actual property may arise.
8.3 Owners reserves the right to make changes to the specification of the property deemed necessary in the light of operational requirements. In the interest of continuous improvement, Owner reserves the right to change the furniture, accessories, services, facilities or activities, either advertised or previously available, without prior notice.
8.4 If significant changes after your booking has been confirmed occur, it will be communicated in due time.
9. NUMBER OF PEOPLE USING THE HOLIDAY ACCOMMODATION
The number of people staying in the property must not exceed the number of sleeping places indicated in the description of the property, except in the case of infants under two years or special agreement. Some properties limit the number of newborns. In the event that the maximum number is exceeded without prior agreement, the property owner or Mallorca reserves the right to deny or revoke Holiday Villas booking, at its sole discretion.
No pets unless agreed otherwise permitted.
The property owner or his agent / access to the property within a reasonable time during any holiday occupancy for inspection and maintenance purposes is permitted. Note that this will be avoided where possible, and visits are limited to a minimum. If you feel an excess in the number of visits, or an invasion of your privacy, please contact your agent that will address the issue promptly.
12. ARRIVAL AND DEPARTURE
You will have access to occupy the property as of 16:00 on the date of start of holiday. The accommodation must be vacated before 10:00 am on the last day unless otherwise stated in the accommodation voucher or agreed with Mallorca Holiday Villas. If these times are difficult, please let us know at time of booking. If your arrival is delayed you must inform us so that the necessary steps can be made for entry into the accommodation.
13. YOUR RESPONSIBILITIES
13.1 - You must keep the accommodation and all furniture, fittings, effects, facilities and equipment in the same state of repair and condition as at the start of the holiday, and leave the accommodation in a reasonable state of cleanliness and the general order that was found. You are responsible for all damage or loss to property or its contents may occur during their occupation, and will be responsible for paying appropriate compensation to the owner or direct to us as agent in case of breakages or damage.
13.2 - You must accept responsibility for the proper conduct of himself and members of his party during the holidays. In case of serious misconduct, we reserve the right to terminate your holiday or any member of your party. This includes threatening behavior, verbal behavior, physical assault and serious danger to our staff or owner. If we do, we will have no responsibility or liability to you. If you or any member of your party willfully, recklessly or negligently cause any damage to any property owned, or person, you agree to indemnify us for any loss suffered by us (including legal costs), arising from such damage. Nonpayment of serious damage to you or your party has inflicted on a property may result in local authorities called to intervene.
14. OUR LIABILITY AND THE PROPERTY OWNER
14.1 - Neither we (as agent for the Property Owner) nor the Property Owner is responsible for the death or injury of you or any person named in the booking form or another person on the property, unless this results from the proven negligence of the owner, ourselves or our employees.
14.2 - Will not be responsible for any loss, breach or delay due to any cause beyond our reasonable control, including but not limited to, acts of God, explosion, flood, tempest, fire or accident, war or threat of war, civil unrest, acts, restrictions, regulations, laws or measures of any kind by any government or local authority, strikes, lockouts or other industrial actions or disputes or adverse weather conditions. In any case, we are entitled to treat the contract as discharged. In the event of such discharge our liability shall be limited to the refund of the amounts paid to us in the corresponding part (unused) vacation, calculated on a pro rata daily basis.
14.3 - In the event of a malfunction, breakage or malfunction of facilities, appliances or furniture, if during your stay do not have a communication problem your reporting this part shall not be entitled to any compensation. No compensation will be applied due to the failure of any device within this period, but, of course, will help to the best of our ability. In the rare case of a total breakdown of basic water supplies, electricity and use of the pool representatives / suppliers concerned shall endeavor to re solve the problem within 24 hours to the nearest working day. We can not be responsible for breakdown of mechanical equipment such as pumps, boilers, systems pool filtration, etc. or the failure of public utilities such as water, gas and electricity.
14.4 - Neither we nor the Property Owner is responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond our control.
14.5 - Building works, serious works and noise resulting from the site can take place at any time during the year on a property adjacent or nearby. If this work is affecting your holiday please inform our representative immediately. Obviously, this is beyond the control of the property owner, or ourselves, but we will do everything possible so that the work stopped, if possible. If this is not possible, we will consider to provide alternative accommodation, if possible similar feature, strictly subject to availability. We did not receive prior notification of when construction will begin as these are carried out by third parties and therefore have no control over this issue. While we can assure that we will do everything possible to minimize any discomfort or interruption of your holiday, we regret that this is a case of force majeure and accept no responsibility or pay any compensation. We monitor closely and will inform you immediately of any construction work that could materially affect your holiday. We consider internal maintenance and use of tile cutters and small power tools not materially affect your holiday.
In the unlikely event that you are disappointed with the accommodation, you must contact us immediately and we will try to solve the problem at the time. If you vacate the property before the end of the rental period without prior notice is received by us before your departure, you lose the rights to compensation.
16. EMERGENCY PHONE
A mobile phone number will be provided to all customers in order to provide assistance outside office hours. It is requested only use this phone number, in case of an actual emergency. Our team will do its best to help you solve any problems that may arise but is not responsible for issues beyond our control. This service is purely assistance offered by us and not replace official emergency services such as fire, ambulance, police, etc.
17. SECURITY AND VALUABLES
Any valuables left at the property are left at your own risk. Neither Mallorca Holiday Villas, nor the Property Owner are responsible for their loss. As with all rental properties in prime locations, there may be a risk of theft. Where provided, burglar alarms must be activated, safes used and proper care taken against theft and burglary. We accept no responsibility for any loss, damage or consequential losses due to theft or any other security related incident howsoever caused. Please be special to allow access to the property to unexpected technical or personal care.
All obligations arising from these booking conditions shall be deemed to come into existence in Spain, and is subject to Spanish law and the exclusive jurisdiction of the Spanish courts.
When we need to collect personally identifiable information from you, we ask you to voluntarily provide us with the information we need. For example, if you want to make a reservation, we will ask for information such as name, address, phone number, email address to process your reservation. We will use your email address to send a confirmation and, if necessary, might use the other information to contact you for help to process the reservation. As shown below (see section E-Mail), we can also use your email address to notify you about special offers and promotions. According to Law 15/1999 of December 13, Protection of Personal Data, Morro Norte, S.L.. You have created an automated file of personal data, which reflect those necessary to process the reservation in our properties. Morro Norte, S.L. guarantees all things necessary measures to ensure confidentiality of the data, which could be query, update or canceled by the owner.
